The following terms of service entail the business encompassed by EricaWaddellClothing.com. Your access to and use of the goods and services provided via the company (herein "Services") is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Services.

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Services.

Terms of Use

The website www.EricaWaddellClothing.com (Site) is engaged in commercial and marketing activities related to the products and  services offered on the Site (Operations). This site is intended for personal use for informational and commercial purposes only.

The information provided on the Site is updated regularly and is intended to be as correct as possible at the time of the most recent Site update. Any errors or omissions pertaining to Site contents or images are strictly unintentional.  

Erica Waddell and all staff associated with operations of businesses owned shall be held harmless for any damages, negligence, inconvenience, or misinformation perceived to be due to use of this Site.  

Privacy Policy

This Site collects nonspecific Visitor information such as time of Site use, length of visit, and number of visitors with unique internet protocol (IP) addresses are monitored using third party applications. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.

We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. Personal information with identifiable data such as name, email address, and billing details require the visitor to opt in as a User by participating in Site activities such as email newsletter sign up, purchase transactions, and blog comment posting. 

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your

personal information will be used for the specific reasons stated above only.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. Payment

A valid payment method, including credit card or PayPal, is required to process the payment for your order. You shall provide www.EricaWaddellClothing.com and related storefronts with accurate and complete billing information, including full name, address, state/province, zip/country code, email/telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize www.EricaWaddellClothing.com and/or its authorized third-party payment processors to charge all Subscription fees incurred through your account to any such payment instruments.

Subscriptions

Some products or services may be offered and billed on a subscription basis (Subscription(s)). You will be billed in advance on a recurring and periodic basis (Billing Cycle). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Erica Waddell Clothing cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting concierge (at) EricaWaddell.com.


Should automatic billing fail to occur for any reason, Help.com, LLC will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Erica Waddell Clothing in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Subscription Users with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Copyright Policy

 

At Erica Waddell Clothing, we respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights (Infringement) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to concierge (at) EricaWaddell.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below.

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
